A Saltsburg man has been found not guilty of the rape of a Westmoreland County woman last year.
32-year-old Donald Swartz was, however, convicted of burglary, terroristic threats, and loitering. Prosecutors are still deciding whether or not to seek a retrial on two counts of sexual assault and one count of aggravated indecent assault, offenses on which the jury deadlocked.
The incident happened on August 14th last year in Oklahoma Borough, when investigators said Swartz went to the woman’s home after making a series of threats against her, and broke into the home and raped her. The defense contended the two had engaged in consensual relations and the woman concocted the rape story because she was angry at not getting a share of some gambling winnings.
Swartz is free on bond while the prosecution decides what to do next, and sentencing is delayed until that time also.
