    McANULTY ASKS FOR HEARING DELAY
Accused of murdering his wife's former lover

    7/23/2010

Richard McAnulty told a Westmoreland County district judge yesterday he needs to delay his preliminary hearing on murder charges because he hasn’t yet hired an attorney and doesn’t know if he can afford one. District Attorney John Peck agreed to the delay.

The 54-year-old McAnulty is accused of shooting to death Richard Mears (III) in Southwest Greensburg on July 11th. He does not qualify financially for a public defender, and he told Senior District Judge Robert Scott that while he is not wealthy, he wants a good attorney so he can get a fair trial. He has contacted a law firm, and hopes to have an attorney in “a few days.”

Scott presided at the proceeding in place of District Judge James Albert.

A woman who was identified as McAnulty’s girlfriend attended the hearing yesterday. Police say the shooting was motivated by an email from Mears to McAnulty’s wife. The two had reportedly had an affair that broke off about a year ago.

McAnulty is being held at the Westmoreland County Prison without bond. In addition to murder, he also faces weapons charges related to his conviction in 1977 on rape and kidnapping charges involving an IUP student.
