InWestmoreland County Courttoday, Judge John Blahovec will conduct a hearing on whether or not he should have ruled on key matters in the Kevin Murphy triple-murder case. Those rulings were made just before the judge recused himself from presiding over the trial.
Murphy, who’s fromConemaughTownshipinIndianaCounty, is accused of shooting to death his mother, sister, and aunt at the family’s business inLoyalhannaTownship,WestmorelandCounty, in 2009. His attorneys, Mark Bolkovac and Bob Bell ofIndiana, contend that Judge Blahovec had an “ethical dilemma” when he rejected defense motions to exclude certain statements Murphy made in the aftermath of the murders and other key evidence.
Blahovec recused himself from the trial to avoid the appearance of a conflict of interest because of his secretary’s involvement in another, unrelated case involving District Attorney John Peck. Judge Al Bell was assigned to the Murphy trial last week, and Bolkovac says he should review the admissibility of the evidence against their client, not Blahovec.
